What is CALEA?

After the recently failed CISPA (Cyber Intelligence Sharing and Protection Act) and SOPA (Stop Online Piracy Act) legislation, many questions have been raised regarding websites and their user's rights to the content they post or communicate online. Now, the FBI is looking for internet companies to build in a backdoor access into websites to allow for easier surveillance of content users.

The Communications Assistance for Law Enforcement Act (CALEA) was introduced in 1994 to assist law enforcement in conducting electronic surveillance. The law requires telecommunication carriers and telecommunication manufactures to modify their equipment by having built in surveillance abilities to aid federal agencies in monitoring telephone communication. CALEA was later extended in 2004 by the FCC to include broadband networks.

The FBI is now proposing an amendment to the law requiring social media websites, instant messaging websites, web-based email services, and peer to peer communication apps like Apples Face-Time to alter existing code to allow for easy government access intended for wiretapping. The proposed legislation even goes as far as making sure the government has the ability to intercept and unscramble encrypted messages. This expansion of CALEA raises a question; do we want to sacrifice our privacy for increased security or would we rather live in a world where the government can easily track our doings on the internet in hopes of monitoring terrorists?

The truth is the FBI can already monitor online terrorist activity by simply obtaining a court order as outlined in the USA Patriot Act. The Patriot Act allows the FBI with a court order to install monitoring software called Carnivore on the equipment of an Internet Service Provider. This allows the FBI to monitor a suspect's Internet activity. So why does the FBI need to increases its already existing ability to monitor suspected criminals?

As technology innovates, the FBI has lost its ability to wiretap electronic communications in the same capacity as it has in the past. This has led to the possibility of the FBI to go dark ("Going Dark"). Going Dark has been an ever increasing worry for the FBI where their surveillance capabilities could diminish as technology innovates further. The FBI has been advocating the new legislation as a means of improving national security and preventing "Going Dark." Others opposed to it, view the legislation as one more government regulation that infringes on citizens' privacy.

A fear many internet users have is that the same technology that can be used to catch the bad guys could just as easily be turned on them for the government to prey on its own citizens, even if there is no suspicion of wrongdoing. While the FBI does not view expanding CALEA as an expansion of an existing wiretap law it does leave a grave image in people's minds of Uncle Sam reading our emails and invading our personal communication networks with great ease.

While there should be a way of monitoring internet traffic to conduct surveillance on suspected terrorists, this expansion of CALEA may not be the way as it provides the government with an ease of access to our personal information never before granted. Overall, the idea of monitoring suspected terrorists sounds like a great idea but not if the cost is a loss of an entire nation's online privacy especially, if the FBI can already wiretap terrorists in a way that does not infringe upon content users' rights.
